Terms of Service

1. Estimates and pricing

Anything you receive online, by text, by phone or by email before we see the job is an estimate. The binding price for a job is the price we name on site, before any work begins, as written on the work order you approve. If you decline that price, we leave and you owe nothing for the estimate. Appliances with refrigerant carry an environmental fee; stairs, disassembly and heavy material can affect the price. All of it is included in the number we name on site.

2. Scheduling

Appointment windows are estimates of arrival time. We will contact you if we are running early or late. Same-day service depends on availability and is arranged by phone or text. You may cancel or reschedule a free estimate at any time without charge.

3. What we can and cannot take

We accept the items listed on our items page. We cannot accept asbestos, medical waste, ammunition, wet-cell batteries, or hazardous materials beyond the limited household quantities we tell you about on site. You represent that you own, or have authority to dispose of, everything you ask us to remove, and that you have removed anything you want to keep.

4. Texting and calls

By providing your mobile number you agree Dump Ninja may text you about your quote and service. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Promotional texts are sent only if you separately opted in, and consent to them is never a condition of purchase. Calls to our tracking numbers may be recorded after a spoken notice.

5. Photos you upload

Photos you submit through the quote form are used to understand the job. You grant us a limited license to store and view them for that purpose. Do not upload anything you do not have the right to share.

6. Payment

Payment is due when the job is complete unless the work order says otherwise. We accept card, cash and check. Returned checks and unpaid invoices may incur collection costs permitted by law.

7. Liability

We are fully insured and we work carefully. Our liability for any claim arising from a job is limited to the amount you paid for that job, except where the law does not allow that limit. We are not responsible for items you asked us to remove, or for pre-existing conditions at the property.

8. Dispute resolution: binding arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

Any dispute, claim or controversy between you and Dump Ninja arising out of or relating to these terms, the website, or any service we provide will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. The Federal Arbitration Act governs this section. The arbitration will take place in Yolo County, California, or by video at your election. Dump Ninja will pay all filing, administration and arbitrator fees for claims under $10,000 unless the arbitrator finds the claim frivolous.

Class action waiver. You and Dump Ninja agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate more than one person's claims.

30-day opt-out. You may opt out of this arbitration agreement by emailing office@dumpninja.com with your name, address and the words "arbitration opt-out" within 30 days of first agreeing to these terms. Opting out does not affect any other part of these terms.

If the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court, and the rest of this section still applies to every other claim.

9. Copyright and DMCA notice

Because visitors can upload photos, Dump Ninja accepts notices of claimed copyright infringement under the Digital Millennium Copyright Act. Send notices to: Copyright Notices, Dump Ninja LLC, 709 Matmor Rd, Woodland, CA 95776, office@dumpninja.com. Include the information required by 17 U.S.C. § 512(c)(3). We will remove material that infringes and may terminate the ability of repeat infringers to upload.

10. The website

The content of dumpninja.com, including photographs, text and design, belongs to Dump Ninja and may not be copied without permission. The site is provided as is. We do our best to keep it accurate, but hours, service areas and offerings can change; the work order controls.

11. General

These terms are governed by California law. If any part is unenforceable, the rest remains in effect. We may update these terms; the effective date and version at the top will change, and material changes will be noted on the homepage for at least 30 days.
